Our focus and passion at Hardacre Law is estate planning.
While we practice in other areas of law, those other areas go hand in hand with estate planning concepts.
By concentrating in one primary practice area, we are able to provide higher quality and more knowledgeable and insightful legal advice.
The first step to the estate planning process is the free, no obligation, consultation. During the initial consultation you will meet with the attorney and discuss your family situation, your assets, your intended beneficiaries, and the goals for your estate plan (as well as how to accomplish them.)
This is primarily an educational meeting for you. And our hope is that by the end of the meeting, you have a basic understanding of all of the different estate planning documents and the various estate planning options available to you, as recommended by the attorney.
After the initial consultation, the attorney will often leave you with a lot of personal decisions to make now that you’re equipped with the attorney’s recommendations. Sometimes making these personal decisions can be one of the hardest parts of this process.
However, once those decisions are made, the fee agreement is signed, and payment is received, the attorney can begin drafting your estate plan (whatever documents that may involve, such as a will, trust, power of attorney, etc.)
After the documents are drafted the attorney will send you the rough draft for you to review and may ask you for additional information. Changes can be made at this time, and it may be necessary to have a follow-up appointment or appointments with the attorney.
The final step of the estate planning process with us is the signing appointment. At the signing appointment, the attorney will explain the provisions in each of the estate planning documents—in layman’s terms—and make any final changes. If everything looks good, then the documents will be executed (signed, witnessed, and/or notarized.)
Assisting with the signing of the documents is usually where our involvement in the estate planning process ends. It is then the client’s responsibility to implement the plan that has been established for them.
An estate plan only works as it was intended to if the client implements it in accordance with the attorney’s instructions. This often includes re-titling of assets, changing or adding beneficiary designations, seeking advice from other professionals, reviewing the plan in the future, etc. While we often help you do this, there is only so much that we can access and do on your behalf. More than likely, you will end up with a “to-do” list. Again though, we are always here to help!
